Terms of Service & Platform Agreement

1. The IP Transfer Clause (Solves the “Blueprint Hostage” issue):

“Upon the Homeowner’s full payment of the Design Retainer and the Designer’s submission of the final deliverables via The Bomb Lawn platform, 100% of the Intellectual Property (IP), usage rights, and ownership of the blueprints transfer to the Homeowner. Designers may not withhold blueprints or restrict the Homeowner from soliciting bids from other Installers on The Bomb Lawn network.”

2. The Quality Standard Clause (Solves the “Useless Sketch” issue):

“All Design Services purchased through The Bomb Lawn must meet platform deliverable standards, including being drawn to recognizable scale and accompanied by a core materials estimate. The Bomb Lawn reserves the right to withhold Designer escrow payouts if the uploaded deliverables do not meet the minimum requirements of the purchased Design Tier.”

3. The Universal Build Credit Clause (Solves the Discount Confusion):

“Design Retainers are non-refundable standalone services. However, as a courtesy to our users, The Bomb Lawn offers a Universal Build Credit. The exact amount paid for the Design Retainer will be applied as a discount strictly toward the final installation invoice, provided the installation is contracted, financed, and paid entirely through The Bomb Lawn platform.”

1. Platform Role and Escrow Mechanics The Bomb Lawn operates as a technology platform connecting property owners (“Clients”) with independent landscaping professionals (“Contractors”). We are not a landscaping company. All financial transactions, including Dispatch Deposits ($49) and Design Retainers, are processed securely via Stripe and held in our platform ecosystem to ensure fair dealing.

2. The Universal Build Credit Design Retainers are non-refundable standalone services. However, The Bomb Lawn offers a Universal Build Credit. The exact amount paid for a Design Retainer will be applied as a discount strictly toward the final installation invoice, provided the physical installation is contracted, financed (e.g., via Wisetack), and paid entirely through The Bomb Lawn platform.

3. Intellectual Property (IP) Transfer Upon the Client’s full payment of a Design Retainer and the Designer’s submission of the final deliverables via The Bomb Lawn platform, 100% of the Intellectual Property, usage rights, and ownership of the blueprints transfer to the Client. Designers may not withhold blueprints or restrict the Client from soliciting build quotes from other Contractors on The Bomb Lawn network.

4. Media and Property Access Rights By requesting a quote or service, Clients grant Contractors permission to access the exterior of the specified property. Clients additionally grant The Bomb Lawn and its Contractors the right to take photographs, videos, or digital scans of the landscaping project before, during, and after completion. These media files may be used for quoting accuracy, platform portfolio displays, and marketing purposes without further compensation to the Client.
